The sale of gift vouchers & over services
The use of “we”, “us” or “our” in this document refers to Kazbah.
KAZBAH provides a service which allows us to sell tickets (“Tickets”) to events held or managed by those Event Holders (“Events”).
KAZBAH will permit you, the customer, to place orders and pay for orders for Tickets and Merchandise in respect of Events.
Your use of the Service and your purchase of Tickets, Merchandise or payment for Vouchers is governed by the terms and conditions set out below (“this Agreement”). This Agreement forms a binding legal agreement between you and KAZBAH. You should read the terms and conditions of this Agreement carefully.
Without limiting the way in which you may be bound by this Agreement, by signing a document agreeing to be bound by this Agreement, by clicking a button on your computer screen including your acceptance of this Agreement, or by proceeding to purchase any Tickets, Merchandise or Vouchers through the Service, you will be deemed to have accepted and will be bound by the terms and conditions of this Agreement.
The service
KAZBAH will provide you with the following (“Service”):
- A secure payment facility to enable you to pay for Tickets, Merchandise and Vouchers for Events held by KAZBAH.
- The supply and delivery to you of Tickets which you have purchased if required. Such Tickets if required will be delivered in an electronic PDF format nominated by you at the time of purchase which will be either to print the Ticket as displayed to you on screen, send you an email containing the Ticket as an attachment or send your Ticket to you as an SMS to your mobile phone. If KAZBAH is not supplying a ticket for a particular event, then the KAZBAH will be responsible for supplying a ticket to you.
KAZBAH will not be responsible for the supply or delivery of Merchandise to you. KAZBAH are responsible for supplying Merchandise to you.
The above Service constitutes KAZBAH’s only obligations to you in respect of the supply of Tickets, Merchandise or payment of Vouchers.
KAZBAH may refuse to sell or supply any Tickets or Merchandise to you or process any payment of Vouchers made by you at any time in its sole and absolute discretion including, without limitation, where you use the Service in an illegal, fraudulent, offensive or unethical manner or make any use of the Service which in KAZBAH’s sole opinion is likely to bring KAZBAH into disrepute or to impact the use of the Service by KAZBAH’s other customers.
Conditions of sale
The following conditions apply to the sale of Tickets and Merchandise and payment of Vouchers and also to your attendance at an Event:
- Tickets, Merchandise and Vouchers must be paid for by credit card or other alternate payment methods offered by KAZBAH from time to time. A purchase will not be processed unless you correctly provide all information requested by KAZBAH at the time of purchase.
- KAZBAH may charge a fee for the replacement of Tickets which are lost or stolen. KAZBAH will be under no obligation to replace general admission Tickets (which are Tickets where seating is not allocated).
- The right of admission is reserved and is subject to KAZBAH and the respective venue’s terms of admission, copies of which may be obtained from the KAZBAH. Late arrival may result in admission to the Event being refused.
- If a concession Ticket is purchased, you may be required to provide valid identification to substantiate any concession at the time of collection of the Tickets or entry to the relevant venue.
- The Event may ban cameras, audio and video recording equipment.
- Events may be broadcast on television, radio or over the internet. As a result of your attendance at the Event, you may appear in these broadcasts with or without your knowledge or consent.
- It may be a condition of entry to individual Events that a search of person and / or their possessions will be required at the time of the entry to the relevant venue.
- Entry may be refused to an Event if Tickets are damaged or defaced in any way or are not purchased from KAZBAH or other authorised points of sale.
- You must not, without the prior written consent of KAZBAH, resell or offer for sale any Tickets you have purchased at a premium to their purchase price. You cannot resell the Tickets on an online auction site. If a Ticket is sold or used in breach of this condition, the Ticket may be cancelled without a refund and the holder of the Ticket may be refused admission to the Event.
- In addition to the price you pay for Tickets, Merchandise or Vouchers, you may be required to pay certain fees and charges which KAZBAH imposes from time to time including, without limitation, any booking fees or handling charges.
- GST and other taxes may apply to the sale/purchase/payment of Tickets, Merchandise or Vouchers. Unless otherwise stated at the time of payment, the prices of Tickets, Merchandise or Vouchers will be inclusive of GST and other applicable taxes.
- There is no refund or exchange on any Voucher, Ticket or Merchandise except as required by law and as otherwise specified by KAZBAH. If a refund is made, KAZBAH may, to the extent permitted by law, retain any booking fee or other fees and charges which KAZBAH has charged you.
- You acknowledge that Kazbah may add, withdraw, reschedule or substitute artists, acts, entertainment, and/or vary advertised programs, prices, venues, seating arrangements and audience capacity.
- You acknowledge that the resale of Tickets in certain circumstances may breach certain laws (including, without limitation, laws related to scalping).
- When purchasing your Tickets or Merchandise, you must allow sufficient time for their collection and delivery prior to the Event.
Validity of gift vouchers
Tickets and Vouchers are sold via our website, email, phone and through our point of sale terminals at our locations. The validity of all paid vouchers are for 12 months from the day of purchase. Extensions can be requested but must be submitted to our head office via phone or email at kazbah@kazbah.com.au. Charity/complimentary vouchers have a varied validity depending on the event and the expiry date is at Kazbah’s discretion. Extensions for charity/complimentary vouchers is at Kazbah’s discretion and depending on the circumstances may not be granted.
Refund policy
Our goods come with guarantees that cannot be excluded under the Australian Consumer Law. You are entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage. You are also entitled to have the goods replaced if the goods fail to be of acceptable quality and failure does not amount to a major failure. If the failure is minor, we reserve our right to offer a replacement. We reserve the right to not offer a refund.
PRIVACY POLICY
Kazbah understands that the privacy of your personal information is important to you. We also understand that providing your personal information to us is an act of trust. We take meeting that trust very seriously.
At Kazbah, we are committed to ensuring the privacy of your personal information and to complying with the Australian Privacy Principles (APPs). The APPs are set out in the Privacy Act 1988 (Cth) (Privacy Act) and govern the collection, use and disclosure of personal information. In summary, personal information is information or opinion about an identified individual, or an individual that is reasonably identifiable.

What personal information does Kazbah collect and hold?
Kazbah provides a range of marketing and promotion tools to its customers, which involve the collection and storage of personal information. These tools include an online marketing platform which enables our customers to conduct targeted marketing campaigns to individuals.
We hold all personal information in our online platform, and the kinds of personal information that we collect generally depends on the kinds of personal information our customers upload into our platform.
In general, we collect the following personal information through our customers: names, contact details, including email addresses, mobile phone numbers, dates of birth and gender.
We also collect some personal information about our customers when they subscribe to, and use our service. This includes their names and contact details
How does Kazbah collect and hold personal information?
Kazbah is committed to collecting personal information lawfully and fairly
In general, most of the personal information we collect comes from our customers as they upload information about their existing and prospective customers into our online marketing platform.
Customers may upload personal information in a number of ways, including the following:
- by uploading a spreadsheet of individuals’ contact details
- through the use of forms on their websites, such as newsletter subscriptions forms or mailing lists
- by using the platform to run contests or competitions and uploading the personal details of entrants
- via “Point of Sale” integration with our online platform. Point of sale systems, such as cash registers, integrate with our online platform and send to us certain personal information as to individuals conducting transactions. The personal information integrated with our platform includes your purchase history, namely what you have purchased at a particular venue
- through manual data entry
When you visit our website, a small data file called a “cookie” is stored on your computer or mobile device by our server.
Like most web site providers, we use cookies to generate statistics about how many people visit our site and how people use our website. We use web logs and cookies to do this. This enables us to keep our site relevant and useful. However, generally this information will not identify you. We do not link this information back to your identity or other information that you have provided to us. We do not store any information that identifies you inside cookies.
Most web browsers are set by default to accept cookies. However, if you do not wish to receive cookies you may set your browser to either inform you as to cookies or refuse cookies.
We also use an online tool called ‘web beacons’. We use web beacons in the marketing messages that our clients send out to individuals. They allow us to generate statistics as to, for example, how many times an email was opened, who opened it, and (if applicable), who unsubscribed from the mailing list.
All personal information is stored in our online platform. MyGuestlist takes all reasonable steps to ensure that the personal information we hold is kept secure at all times. All back-up data is encrypted and kept in a safe offsite location.
For which purposes does Kazbah collect, hold, use and disclose personal information?
We collect, hold, use and disclose personal information for the following purposes:
- to provide our customers with the marketing and promotional tools they request
- to provide customer support and maintenance, and to ensure the integrity of the data that we collect and hold
- to market our services to existing and prospective customers
Kazbah’s policy is not to disclose or sell any of the personal information we hold to a third party unless we have the written consent of the individuals concerned. However, we may disclose personal information as permitted under the Privacy Act, or as required by law.
How do I opt out of direct marketing?
If you do not wish to receive direct marketing communications from us, you can opt-out of our mailing list by unsubscribing from our newsletters or by emailing us direct at: kazbah@kazbah.com.au.
How can you access and correct the personal information Kazbah holds about you?
The Privacy Act gives you the right to access and correct the personal information we hold about you.
If you wish to access and/or correct your personal information, please send your request to kazbah@kazbah.com.au.
As Kazbah also provides a service for our clients to securely store their data, we may need to direct your enquiry to our clients to provide you with access to the information
Subject to the provisions of the Privacy Act, we can make your personal information accessible to you by providing you with a copy of the relevant information (ordinarily in the form of an electronic print out or photocopy). Please note that we may charge you a fee for the reasonable cost of providing such access.
Kazbah will take reasonable steps to ensure that information we have about your company is accurate, complete, relevant and up to date when we collect and use it. To this end, we may, from time to time, contact you in regards to keeping this data accurate and up to date.
How can you make a complaint?
You have the right to make a complaint about the way we handle your personal information. If you wish to make a complaint, please set it out in writing and send it to kazbah@kazbah.com.au.
We will deal with all complaints within a reasonable timeframe. If you are not satisfied with our response, you may make a complaint to the Office of the Australian Information Commissioner (OAIC): http://www.oaic.gov.au/privacy/making-a-privacy-complaint.
